Welcome to Sam W Studio. By accessing this website, purchasing artwork, booking workshops, commissioning artwork, or engaging with any services offered by Sam W Studio ("the Artist", "we", "us", or "our"), you agree to the following Terms of Service.

1. General

These Terms of Service govern the use of this website and all products and services provided by Sam W Studio.

Nothing in these Terms excludes, restricts, or modifies any rights available to consumers under the Australian Consumer Law.

We reserve the right to update these Terms at any time. Changes become effective upon publication on this website.

2. Original Artwork

All original artworks sold through Sam W Studio are one-of-a-kind artworks created by the Artist.

Colours may vary slightly between on-screen images and the physical artwork due to differences in screen settings, photography, and lighting.

Dimensions listed are approximate and may vary slightly.

Ownership of artwork transfers to the purchaser once full payment has been received.

Copyright remains with the Artist unless otherwise agreed in writing.

3. Prints

Prints are produced from original artwork created by the Artist.

Limited edition quantities, sizes, and availability are determined solely by the Artist.

Print colours may vary slightly from website images due to monitor and printing differences.

4. Commissions

Commissioned artwork is subject to separate Commission Terms & Conditions available on this website.

By paying a commission deposit, the Client acknowledges acceptance of those terms.

The Artist will make every reasonable effort to create artwork that reflects the agreed brief while maintaining artistic interpretation and creative discretion.

5. Workshops & Classes

Workshop and class bookings are confirmed upon receipt of payment.

Participants attend workshops at their own risk.

Children attending youth workshops must have parent or guardian consent.

The Artist reserves the right to refuse participation where behaviour is disruptive, unsafe, or impacts the experience of other attendees.

Workshop content, demonstrations, teaching materials, worksheets and resources remain the intellectual property of the Artist and may not be reproduced, recorded, distributed, or sold without written permission.

6. Online Workshops & Digital Products

Digital content, downloadable resources, recordings, and online workshops are provided for personal use only.

Access may not be shared, copied, reproduced, distributed, resold, or made publicly available.

Purchase of a digital product grants a non-transferable licence for personal use only.

7. Pricing & Payments

All prices are listed in Australian Dollars (AUD).

Prices may be changed at any time without notice.

Full payment is required before artwork, products, workshop materials, or digital content are released unless otherwise agreed in writing.

The Artist reserves the right to cancel or refuse any order where payment has not been received.

8. Shipping & Delivery

Shipping costs are calculated separately unless otherwise stated.

Estimated delivery times are provided as a guide only and are not guaranteed.

Once artwork has been handed to a courier or postal provider, delivery timeframes are outside the Artist's control.

The purchaser is responsible for providing accurate delivery information.

Additional shipping charges resulting from incorrect information may be charged to the purchaser.

9. Returns & Refunds

Returns and refunds are governed by the Australian Consumer Law.

We do not offer refunds for change of mind purchases.

If an artwork, print, workshop, or product is faulty, damaged, significantly different from its description, or does not meet consumer guarantees under Australian law, please contact us promptly so we can work towards an appropriate remedy.

Commission deposits are non-refundable as outlined in the Commission Terms & Conditions.

Workshop cancellation policies may be specified separately at the time of booking.

10. Gift Vouchers

Gift vouchers are redeemable only through Sam W Studio.

Gift vouchers are not redeemable for cash and are non-refundable.

Lost or expired vouchers may not be replaced.

11. Intellectual Property

All artwork, images, photographs, website content, workshop materials, written content, branding, logos, and designs remain the intellectual property of Sam W Studio unless otherwise stated.

Purchasing artwork does not transfer copyright ownership.

Artwork may not be copied, reproduced, scanned, modified, licensed, sold, used commercially, minted as NFTs, or reproduced in any format without written permission from the Artist.

12. Artist Promotion Rights

The Artist reserves the right to photograph and reproduce images of artwork for marketing, exhibition, publication, portfolio, educational, and promotional purposes.

This includes commissioned artworks unless otherwise agreed in writing before commencement.

13. Acceptable Conduct

Users of this website and participants in workshops are expected to behave respectfully.

We reserve the right to refuse service, cancel bookings, remove participants, or decline commissions where behaviour is abusive, threatening, discriminatory, unlawful, or otherwise inappropriate.

14. Limitation of Liability

To the extent permitted by law, Sam W Studio is not liable for indirect, incidental, or consequential loss arising from the use of this website, participation in workshops, or the purchase of products and services.

Nothing in these Terms limits rights provided under the Australian Consumer Law.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of Queensland.
