In-Person Workshop Terms & Conditions
These Terms & Conditions apply to all in-person workshops, classes, courses and creative programs facilitated by Sam W Studio.
By registering for a workshop, the participant (or parent/legal guardian where the participant is under 18 years of age) acknowledges and agrees to the following:
1. Participation & Supervision
Participants attend workshops at their own risk.
For workshops involving children under 18 years of age, supervision is provided only for the advertised workshop duration. Parents or guardians are responsible for ensuring children arrive and are collected on time unless otherwise specified.
Participants are expected to follow all instructions provided by the facilitator to ensure a safe and enjoyable experience for everyone.
2. Workshop Activities
Workshops may involve the use of paints, inks, pencils, collage materials, adhesives, scissors, mixed media materials and other art supplies.
While all reasonable care is taken to provide a safe environment, participation in creative activities carries an inherent level of risk.
Participants acknowledge and accept responsibility for participating in workshop activities.
3. Medical Information & Additional Needs
Participants, or parents/guardians of participants under 18 years of age, are responsible for disclosing any relevant medical conditions, allergies, accessibility requirements or additional support needs at the time of booking and for advising of any changes prior to the workshop.
4. Behaviour Expectations
All participants are expected to behave respectfully towards the facilitator, venue, materials and fellow participants.
Where behaviour becomes unsafe, disruptive, abusive or impacts the experience of others, the facilitator reserves the right to ask the participant to leave the workshop.
In the case of children, parents or guardians may be contacted and asked to collect the participant.
No refund will be provided where removal from a workshop results from inappropriate behaviour.
5. Materials & Artwork Care
Unless otherwise stated, standard workshop materials are included in the workshop fee.
Participants are encouraged to wear appropriate clothing as art materials may stain.
All reasonable care will be taken with artworks created during workshops. However, marks, smudges, damage or alterations may occur as part of the creative process and cannot always be prevented.
Participants are responsible for transporting completed artworks safely following the workshop.
6. Photography & Media
Photography and video may be taken during workshops for promotional, educational and marketing purposes.
Consent preferences may be collected during the booking process.
Participants, or parents/guardians of participants under 18 years of age, may opt out of photography and promotional use by notifying the facilitator prior to the workshop.
7. Bookings & Payment
Bookings are confirmed once full payment has been received.
Places are limited and allocated on a first-come, first-served basis.
Workshop places cannot be guaranteed until payment has been successfully processed.
8. Minimum Enrolments
Workshops may require a minimum number of participants to proceed.
If minimum enrolments are not reached, participants will be notified as soon as possible and offered either:
a full refund; or
transfer to an alternative workshop date, where available.
9. Cancellations & Refunds
Workshop places are limited and reserved specifically for each participant.
Cancellations made more than 7 days prior to the workshop date will receive a refund less any booking, administration or payment processing fees.
Cancellations made within 7 days of the workshop date are generally non-refundable unless the place can be filled by another participant.
Failure to attend a workshop is considered a cancellation and is non-refundable.
If a workshop is cancelled by the facilitator due to illness, venue issues, insufficient enrolments, extreme weather events, government restrictions or other unforeseen circumstances, participants will be offered either a full refund or transfer to an alternative date where available.
10. Workshop Changes
The facilitator reserves the right to make reasonable changes to workshop content, projects, materials, venue, timing or structure where required.
Any changes will be made with the intention of maintaining the overall quality and learning outcomes of the workshop.
11. Intellectual Property
Workshop projects, lesson plans, worksheets, demonstrations, reference materials and teaching resources remain the intellectual property of Sam W Studio unless otherwise stated.
Artwork created by participants during workshops belongs to the participant. However, workshop content and teaching materials may not be reproduced, recorded, taught, distributed, published or sold without prior written permission.
Where workshops involve studying the work of other artists, those studies are intended for personal learning purposes only. Participants are responsible for ensuring any reproduction, publication or sale of work inspired by another artist complies with applicable copyright laws and permissions.
12. Privacy
Personal information collected during the booking process is handled in accordance with the Sam W Studio Privacy Policy available on this website.
13. Liability
All reasonable care will be taken to provide a safe and enjoyable workshop experience.
To the extent permitted by law, Sam W Studio, its facilitators and venue partners are not responsible for any injury, loss, damage or expense arising from participation in a workshop, except where required under Australian Consumer Law.
Nothing in these Terms & Conditions excludes rights available under the Australian Consumer Law.
14. Acceptance of Terms
By registering for an in-person workshop, the participant, or parent/legal guardian where applicable, confirms they have read, understood and agree to these Terms & Conditions.
15. Additional Terms for Children's Birthday Parties
The following terms apply specifically to children's birthday party bookings facilitated by Sam W Studio.
Parent or Guardian Attendance
At least one parent or legal guardian of the birthday child must remain at the venue for the duration of the party.
Where a venue has limited capacity, we may not be able to accommodate all parents or guardians within the workshop space. Parents are welcome to utilise nearby cafés, waiting areas or other facilities where available and remain contactable throughout the party.
Food & Birthday Cake
Birthday cake is welcome, and time is generally allocated at the end of the party for cake and celebrations.
To help maintain a safe and enjoyable creative environment, we kindly ask that food not be served during the art activities. Through experience, we have found that art materials and food are best enjoyed separately.
The person booking the party is responsible for supplying and serving any food, drinks or cake unless otherwise agreed.
Decorations
Simple decorations such as balloons are welcome.
However, due to venue requirements, decorations must not be attached to walls, ceilings, furniture, artwork or fixtures unless prior approval has been obtained.
Where extensive decorating is desired, an exclusive venue hire or out-of-hours booking may be available at an additional cost, subject to availability.
Guest Numbers & Changes
Final guest numbers should be confirmed no later than 14 days prior to the party date.
Reasonable adjustments to guest numbers may be accommodated up until this time.
After the final confirmation date, refunds cannot be provided for guests who are unable to attend due to illness, scheduling conflicts or other personal circumstances.
Illness & Absences
If a child is unwell, we kindly ask that they do not attend the party.
Where practical, Sam W Studio may provide a take-home art kit or alternative arrangement for absent guests; however, this is at the facilitator's discretion and subject to available materials.
Supervision & Responsibility
While art activities are supervised by the facilitator during the party, parents and guardians remain responsible for the behaviour, wellbeing and medical needs of attending children.
Any allergies, medical conditions or additional support needs that may affect participation should be disclosed prior to the party.
